Labor market programs for severely disabled people are an important instrument for securing skilled workers.
In accordance with Section 16 of the Severely Disabled Compensation Levy Ordinance, a new labor market program "Workplaces for Particularly Affected Severely Disabled People up to the Age of 50" was adopted in the state of Saxony-Anhalt in 2013.
The labor market program is regionally limited and applies from April 1, 2013 to December 31, 2015. The total volume amounts to 5 million euros.
It covers employment relationships subject to social insurance contributions that are established during this period.
Funding is provided for the recruitment and employment of the following severely disabled people as defined in section 104(1)(3)(a) to (d) of the Ninth Book of the German Social Code:
a) Particularly affected severely disabled people as defined in section 72(1)(1)(a) to (e) of the Ninth Book of the German Social Code up to the age of 50 (for those affected from the age of 50, funding is provided in accordance with Article 3 of the Directive of the Federal Ministry of Labor and Social Affairs on the Inclusion Initiative of Sept. 9.2011); these are people
- who require special assistance to perform their employment on a more than temporary basis;
- whose employment involves extraordinary expenses for the employer as a result of their disability on a more than temporary basis;
- who, as a result of their disability, are obviously able to perform only a substantially reduced amount of work, not only temporarily; or
- who have a degree of disability of at least 50 solely as a result of mental or emotional handicap or a seizure disorder;
- or who, because of the nature and severity of their disability, have not completed vocational training within the meaning of the Vocational Training Act;
b) long-term unemployed young severely disabled persons up to the age of 30.
C) employees from workshops for disabled people;
d) graduates of special schools and graduates of inclusive schools with special educational needs
e) single parents of severely disabled people.
The support services are provided on the basis of integration subsidies for eligible wages in accordance with Sections 88-90 of the Third Book of the Social Code.
Pursuant to Section 88 of the Third Book of the Social Code, severely disabled people within the meaning of Section 104 (1) No. 3 a-d of the Ninth Book of the Social Code, whose placement is difficult due to personal reasons, may receive a subsidy pursuant to Section 90 (2) of the Third Book of the Social Code amounting to a maximum of 70 percent of the eligible remuneration for a subsidy period of up to 60 months. The subsidy period for the target groups specified in the agreement is at least 36 months.
In accordance with Section 90 (4) Sentence 3 of the Third Book of the Social Code, the integration subsidy is to be reduced by 10 percent per year after 24 months.
Provided that the agencies for employment/providers of basic benefits reach the subsidy period of 36 months when granting the aforementioned subsidies, the subsidies for the people in the target group are increased by 20 percent per year from the equalization levy to be taken into account in accordance with Section 91 of the Third Book of the Social Code.
For graduates of special schools and graduates of inclusive schools with special educational needs, as well as for employees of workshops for disabled people, support amounting to 50 percent of the remuneration to be taken into account in accordance with Section 91 of the Third Book of the Social Code can be granted in the fourth and fifth year solely from funds from the equalization levy.
Applications for funding are accepted by the agencies responsible for basic security under the Second Book of the Social Code and the Third Book of the Social Code (employment agencies or job centers and job centers of the approved municipal agencies), which also decide on the amount of funding.
